The Quick & Bristly: Calling someone a “contractor” doesn’t make them one. The IRS looks at behavioral and financial control, not your paperwork — and misclassifying an employee can mean back payroll taxes, penalties, and interest.

Somewhere in your first year of hiring help, you will be tempted to make someone a 1099 contractor instead of a W-2 employee. It’s simpler. No payroll taxes, no benefits, no workers’ comp premium. You write them a check, they invoice you, everyone goes home happy.

Why getting it wrong is expensive

If the IRS reclassifies a contractor as an employee, you can owe:

One 2026 update, unrelated to classification
|

The 1099-NEC reporting threshold jumped to $2,000 for payments made in 2026, up from $600. That changes your paperwork — not your classification obligations. A contractor you pay $1,800 is still governed by the same three-part test, whether or not you owe them a form.

If you’re not sure which one you have, treat that uncertainty as the signal to check now, before you build a habit around the wrong answer. Form SS-8 lets either you or the worker ask the IRS to make the call directly.

Here’s the fact that catches new business owners off guard almost every time: paying for something is not the same as owning it.

The employee default
|
|
If your employee builds your website or designs your logo within the scope of their job, it’s automatically “work made for hire” — you own it the moment it’s created, no paperwork required.

The contractor default (it’s the opposite)
|
|
A contractor’s work only counts as “work made for hire” if both are true:

It falls into one of nine narrow legal categories (think contributions to a collective work or a translation — most creative work, like a website or logo, doesn’t qualify on its own)

Both parties signed a written work-for-hire agreement before the work started

Miss either condition, and the contractor owns the copyright — not you. Even though you paid the invoice, it was your idea, and it lives on your website.

The fix: an assignment clause

Most contracts skip the narrow work-for-hire categories entirely and use an assignment clause instead — the contractor agrees to transfer all rights in the finished work to you upon full payment.

Trademark rights come from use in commerce, not from a contract. But if a contractor registers a domain or social handle on your behalf, put it in writing up front that it belongs to the business — not to them personally.
